A warehouse fall the employer said was carelessness, and a risk assessment that had not been reviewed in four years.

Our client fell six metres from a mezzanine edge with a guardrail that had been removed for a delivery and never replaced. Liability was denied on the basis of contributory negligence.

What we did

Disclosure of the maintenance log showed the guardrail had been removed eleven times in two years and replaced late on nine of them. The pattern, not the single incident, decided the case.

Outcome

Liability admitted in full at the pre-trial review. Damages settled at £1.4 million including a periodical payment for care.
